Background
Qaiser Ahmed Mir, 31, a local shopowner from Kashmir, was among the mourners who were arrested in June 2021 for raising “anti-India” and “pro-freedom” slogans during the funeral of Amin Dar.
Dar was killed in a car accident near his hometown of Bumhama in north Kashmir. Qaiser was among the mourners who raised slogans against human rights violations by the Indian security forces in the valley.
Subsequently, the draconian anti-terror law Unlawful Activities Prevention Act (UAPA), was invoked, citing the “unlawful activities” of the mourners and activists. The United Nation expressed concern in 2020 about the potential misuse of the UAPA, which “authorizes warrantless searches and individual arrests.”
Charges and Allegations
Sections 188 (disobedience to an order duly promulgated by a public servant) and 147 (punishment for rioting), besides the stringent UAPA.
